Terms of Service

1. About StuHaul

StuHaul is a peer-to-peer marketplace that connects student riders with independent transportation providers. StuHaul is not a transportation provider, motor carrier, or common carrier. StuHaul is a Motor Transportation Broker as defined under Texas Transportation Code Chapter 646.

StuHaul does not own, operate, control, or employ any vehicle or driver. All transportation services are performed exclusively by independent licensed carriers who have agreed to the Provider Agreement.

2. Acceptance of Terms

By accessing or using the StuHaul platform (the "Service"), you agree to be bound by these Terms of Service and all applicable laws. If you do not agree to these terms, do not use the Service.

StuHaul reserves the right to modify these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

3. The Marketplace Relationship

StuHaul operates as a booking marketplace. Our role is limited to:

  • Providing a platform for students to discover and book transportation services
  • Facilitating payment processing between students and providers
  • Issuing booking confirmations and QR boarding passes
  • Reviewing provider credentials prior to listing

Providers are solely responsible for the transportation services they offer, including vehicle safety, driver qualifications, scheduling, and compliance with applicable laws. StuHaul is not a party to the transportation contract between student and provider.

4. Bookings and Payments

StuHaul supports the following payment methods, as set by each provider:

  • Stripe — secure card payment processed by Stripe, Inc. Subject to Stripe's terms.
  • Zelle / Cash (Offline) — payment made directly to the provider outside the platform. StuHaul does not process or guarantee offline payments.

StuHaul charges a platform service fee on Stripe transactions. This fee covers platform operations and is non-refundable unless the booking is cancelled within the provider's stated cancellation window.

Refund eligibility is governed by the provider's cancellation policy displayed at booking. Platform credits may be issued in lieu of cash refunds in certain circumstances. Credits are non-transferable and expire as stated at time of issuance.

5. Provider Obligations

By listing services on StuHaul, providers warrant and represent that they:

  • Hold a valid TxDMV Certificate of Registration under Texas Transportation Code §643.051
  • Possess a valid USDOT Number
  • Ensure all drivers of 9+ passenger-for-hire vehicles hold a CDL with Passenger (P) endorsement
  • Maintain commercial auto insurance of at least $1,000,000 per occurrence with StuHaul named as additional insured
  • Comply with all applicable Texas and federal motor carrier safety regulations

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STUHAUL'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE IS LIMITED TO THE PLATFORM SERVICE FEE YOU PAID FOR THE SPECIFIC BOOKING GIVING RISE TO THE CLAIM.

STUHAUL IS NOT LIABLE FOR ANY TRANSPORTATION INCIDENT, PERSONAL INJURY, PROPERTY DAMAGE, OR OTHER LOSS ARISING FROM SERVICES PROVIDED BY AN INDEPENDENT PROVIDER. YOUR SOLE REMEDY FOR TRANSPORTATION-RELATED CLAIMS IS AGAINST THE PROVIDER.

STUHAUL IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND.

7. Dispute Resolution

Disputes regarding the quality, safety, or execution of transportation services are between the student and the provider. StuHaul may, at its sole discretion, facilitate communication between the parties but is not obligated to mediate or resolve such disputes.

Disputes regarding platform fees or booking charges should be submitted to our support form within 30 days of the transaction.

8. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any legal action arising from these Terms shall be brought exclusively in the courts of Travis County, Texas.
